Contract Overview

When you place an order through our website, you are making a binding offer to purchase the selected goods. The contract is concluded once we confirm your order via email.

Changes to Terms

We may update these terms occasionally. Any changes will be effective for new orders placed after the terms are updated.

Placing an Order

To place an order:

  1. Add items to your cart and proceed to checkout.
  2. Provide accurate personal and shipping details.
  3. Review and confirm your order before submitting it.

By clicking “Order with obligation to pay,” you agree to these terms and to pay the total price.

Payment and Invoicing

You must pay for the goods before they are shipped. Payments can be made via credit card using secure payment gateways. After payment, an invoice will be emailed to you and available in your account.

Shipping and Delivery

Shipping fees and delivery options will be displayed at checkout. The final total price includes all applicable fees. Ownership of the goods passes to you upon full payment and delivery.

User Accounts

Creating an account allows you to save your details and track your orders. You are responsible for keeping your login details secure. We reserve the right to terminate accounts that are inactive for over three years or violate these terms.

 

DELIVERY AND TRANSFER OF RISK

The goods will be delivered within 30 days (usually sooner) through your chosen carrier (DPD, DHL Express). Delivery is only available to destinations serviced by these carriers. Delivery time depends on availability and your selected delivery and payment method. You will be informed of the estimated delivery time in your order confirmation.

When you receive the goods, it’s your responsibility to check the packaging for any damage. If the packaging is damaged or appears tampered with, inform the carrier and us immediately. You are not required to accept damaged goods.

If you refuse to accept the goods without valid reason, it does not cancel our obligation to deliver them, nor does it cancel the contract. However, we may withdraw from the contract due to your material breach or store the goods, for which you must pay.

If the goods must be delivered again or by a different method due to issues on your side, you will need to pay the additional delivery costs. These costs will be sent to you via email and are payable within 14 days.

The risk of damage to the goods passes to you once you accept them. If you fail to accept the goods without valid reason, the risk passes when you had the opportunity to take them.

In the event of a delay in production or from our supplier, we will inform you of the new estimated delivery time or any issues with the availability of the goods.

 

DEFECTIVE GOODS AND CLAIMS

We guarantee the goods will be free from defects when the risk of damage is transferred to you. Specifically, the goods will:

  • Match the agreed description, type, quantity, and quality.
  • Be suitable for the intended purpose.
  • Include necessary instructions and accessories.
  • Match any samples provided before the contract.

In the case of defective goods, you can notify us via email and file a claim using our complaint form (Appendix 1). You can choose one of the following remedies:

  • Exchange the goods.
  • Request missing parts.
  • Ask for a reasonable discount.
  • Withdraw from the contract.

If your selected remedy is impractical or too costly, we may offer an alternative. You can also request a discount or withdraw from the contract if:

  • We refuse or fail to fix the defect within the legal timeframe.
  • The defect recurs or is a major issue.
  • It’s clear that the defect cannot be fixed within a reasonable time or without significant inconvenience.

Claims will be resolved within 30 days, and we will notify you via email. If the claim is valid, you are entitled to reimbursement for reasonable costs, provided you supply receipts or other proof of expenses.

 

WITHDRAWAL FROM THE CONTRACT

If you are a consumer, you can withdraw from the contract without giving a reason within 14 days of receiving the goods, as per Section 1829 of the Civil Code. If the contract involves several goods or parts, this period starts when you receive the last item.

To withdraw, send us an email using the withdrawal form (Appendix 2). You must return the goods within 14 days at your own cost. We will refund the purchase price and delivery costs up to the amount of the cheapest delivery method we offer.

Refunds will be issued within 14 days after we receive the goods or proof that they’ve been sent. If the goods’ value has been reduced due to handling beyond what is necessary, we may deduct this from your refund.

We may withdraw from the contract if we cannot deliver the goods for any objective reason (e.g., supplier issues) or if you provided incorrect information.

 

DISPUTE RESOLUTION

We handle consumer complaints via email: support@bitnikgames.com. Use the European Commission’s online dispute platform (http://ec.europa.eu/consumers/odr), if a complaint via email is not a solution.

 

FINAL PROVISIONS

All correspondence will be via email to the addresses provided in the contract.

We may amend these terms for future contracts. Any changes will not affect existing contracts.

In case of force majeure (natural disaster, pandemic, etc.), neither party is liable for damages. If such an event lasts over 10 days, both parties may withdraw from the contract.

These terms and conditions are effective as of 11/09/2024.
